1. Acceptance and Scope
1.1These Terms govern access to and use of the Cloud Nine website, pages, forms, content, and online features.
1.2A person who does not agree to these Terms must not use the website.
1.3Service purchases are governed by the accepted Quote, the Cloud Nine Terms of Service, and any applicable addendum. These Website Terms do not replace those documents.
2. Permitted Use
2.1A person may use the website only for lawful personal or business inquiries and for evaluating or obtaining Cloud Nine Services.
2.2A person must not misuse the website, interfere with its operation, bypass access controls, introduce malicious code, scrape or harvest data without written permission, impersonate another person, submit false or unlawful content, infringe rights, or use the website to harm another person or system.
2.3Cloud Nine may restrict or end access when it reasonably believes a person violated these Terms, created a security risk, or used the website unlawfully.
3. Website Content and Ownership
3.1The website and its text, graphics, photographs, videos, designs, logos, layouts, software, and other content are owned by Cloud Nine or its licensors and are protected by applicable intellectual property laws.
3.2Cloud Nine grants a limited, revocable, nonexclusive, nontransferable right to view and use the website for its intended purpose.

4. Submissions and Forms
4.1A person submitting a form or other content represents that the submission is accurate, lawful, and submitted with authority and that it does not violate another person’s rights.
4.2A person must not submit full payment card details, account passwords, government identification numbers, medical records, or other sensitive information unless Cloud Nine expressly requests it through an authorized secure method.
4.3A submission does not create a service agreement, reserve a date, guarantee availability, or require Cloud Nine to accept work. A service agreement arises only through the acceptance method stated in the Cloud Nine Terms of Service.
4.4A person grants Cloud Nine a nonexclusive right to use a submission to respond to the inquiry, prepare a Quote, provide requested features, protect the website, and comply with law.
4.5Personal information in a submission is handled under the Cloud Nine Privacy Policy.
5. Quotes and Website Information
5.1Website descriptions, examples, portfolios, packages, prices, availability statements, and timelines are general information unless incorporated into an accepted Quote.
5.2Cloud Nine may correct an error or update website information before a Quote is accepted.
5.3A website submission or automated response is not a promise that a Service, date, venue, vendor, price, or deliverable is available.
6. Third Party Links and Services
6.1The website may link to or use a third party site, map, payment service, social network, embedded content, analytics service, or other service.
6.2Cloud Nine does not control a third party service and is not responsible for its availability, content, security, privacy practices, or terms.
6.3A person uses a third party service at that person’s own risk and under the third party’s terms.
7. Disclaimer
7.1The website is provided on an “as is” and “as available” basis to the fullest extent permitted by law.
7.2Cloud Nine does not warrant that the website will be uninterrupted, error free, secure, or free of harmful components or that website content will be complete, current, or suitable for a particular purpose.
7.3Website content is not legal, tax, financial, medical, or other professional advice.
7.4A nonwaivable warranty or consumer right remains unaffected.
8. Limitation of Liability
8.1To the fullest extent permitted by law, Cloud Nine is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of or inability to use the website.
8.2To the fullest extent permitted by law, Cloud Nine’s aggregate liability arising solely from website use will not exceed the greater of the amount the claimant paid Cloud Nine for that website use or 100 United States dollars.
8.3Sections 8.1 and 8.2 do not apply to fraud, willful misconduct, gross negligence, personal injury or property damage caused by negligence, or liability that applicable law does not permit the parties to limit.
9. Privacy and Security
9.1The Cloud Nine Privacy Policy governs personal information collected through the website.
9.2A person is responsible for using reasonable security when accessing the website and for protecting any device or account used to submit information.
10. Governing Law and Disputes
10.1Florida law governs these Terms without regard to conflict of laws principles.
10.2Before filing a claim, a person and Cloud Nine will give written notice describing the dispute and confer in good faith for at least 15 calendar days.
10.3A court proceeding arising solely from website use must be brought in a court with jurisdiction in Miami Dade County, Florida, except where applicable law requires another venue.
11. Changes
11.1Cloud Nine may update these Terms by posting a new version and effective date.
11.2A change applies prospectively. Continued website use after the effective date constitutes acceptance of the updated Terms.
12. General Terms
12.1If a provision is unenforceable, it will be limited only as necessary and the remaining provisions will continue.
12.2A waiver must be in writing and applies only to the specific instance stated.
12.3These Terms are the entire agreement about website use and do not amend an accepted service agreement.
