Terms and Conditions

The COMPANY means Premium Romance Concierge Cloud Nine that is a property of Precious Pics Production Inc.  located at 1780 NE, 191st St, Miami, FL, 33179.

SERVICES :

COMPANY provides the following SERVICES (hereinafter «SERVICES») for the CLIENT or third party beneficiary:

  • Personalized ideas for CLIENT`s special occasion based on completed Cloud Nine Questionnaire.
  • Full Event Planning Services and Event Coordination.
  • Wow Week Gift Delivery Service.
  • Communication via email and messengers until EVENT is executed.

CONTRACT — a contract signed between the COMPANY and CLIENT associated with purchase of COMPANY’S SERVICES, UNIQUE EVENT, PACKAGE or other related services provided by the COMPANY.

CLIENT means the person or parties which consult and/or retain the COMPANY to provide the SERVICES for themselves or third party beneficiaries. Intended services beneficiary- a third party for whom CLIENT purchases COMPANY’S SERVICES.

EVENT means PACKAGE event or UNIQUE EVENT.

PACKAGE means any all-in-one-package, that listed on the website prccloudnine.com and included «The Dinner on the Rooftop Byron», «The Dinner on the Rooftop Remark», «The Dinner on the Rooftop Shakespeare», «The Lighthouse Dinner Jule Verne», «The Picnic on the beach Hemingway», «The Walk with Surprises Lewis Caroll».

After purchasing the above mentioned PACKAGE ( excluding «The Walk with Surprises Lewis Caroll»), CLIENT will be able to customize or make changes based on CLIENT’S preference to the EVENT’s decor, CLIENT’S choice of flowers, Menu or music offered by the COMPANY.

THE UNIQUE EVENT means any event that will be creating by the CLIENT`s request.

THE GIFT DELIVERY SERVICE marketed as WOW week, is a Gift Delivery Service, during which CLIENT or third party beneficiary for whom the services will be provided will receive daily GIFTS during the 7-day period based on CLIENT’s gift choice after completing the Company’s Questionnaire. The COMPANY is responsible for wrapping and delivering gifts to the intended recipient.

QUESTIONNAIRE means the list of questions about preferences and interests of recipient and/or preferences and interests of CLIENT.

PROPOSAL means offer that includes event planning services or gift delivery services estimate, referral pictures and all other related information the COMPANY and CLIENT will exchange.

INSTRUCTIONS means step by step instructions that will be given to the CLIENT to follow through the SERVICES provided by the COMPANY.

EVENT PLANNING/PACKAGE TERMS AND PAYMENT SCHEDULE

After CLIENT chooses the Company’s PACKAGE and/or UNIQUE EVENT or any other applicable SERVICE provided by the COMPANY, a written CONTRACT describing terms and conditions of the SERVICES and payment schedule will be signed by the CLIENT.

The initial 50% (fifty) deposit of the entire Services price must be tendered by CLIENT at the moment of signing. The remaining payment must be tendered no later than 7 (seven) DAYS prior to the scheduled event.

QUESTIONNAIRE will be emailed to the CLIENT in order to get information about all available customizations. QUESTIONNAIRE could be submitted via phone call, Skype call or messengers and must be completed with the CLIENT.

When the CLIENT confirms the QUESTIONNAIRE, the CLIENT will have an opportunity to correct, change, revise, or edit any information which had been provided to COMPANY previously in 5 (five) days before the event . If CLIENT is unable to provide specific information, then whatever information is available and accurate to the best of the CLIENT’S knowledge, will be sufficient.

After the remaining payment is tendered CLIENT will receive personalized INSTRUCTIONS as to coordination of the final steps of the EVENT.

CLIENT will receive post production materials (photo and/or video footage) based on services terms and schedule outlined in the initial PROPOSAL.

COMPANY will attempt to accommodate all requests to the best of its capability. Due to the nature of events, in some instances requests or plans which appear reasonable before the EVENT, may turn out impractical or impossible to complete.The COMPANY appreciates your understanding and cooperation regarding this eventuality.

UNIQUE EVENT TERMS AND PAYMENT SCHEDULE

Upon payment of $300 (non refundable deposit), CLIENT will receive unique Proposal of Dating Ideas or events. Client will make a selection of choice based on filled out QUESTIONNAIRE submitted by the CLIENT to the COMPANY.

All questions from the QUESTIONNAIRE could be submitted via phone call, Skype call or messengers. After getting a completed QUESTIONNAIRE and deposit, within 24 hours COMPANY will send a list with 3-5 brief event ideas with estimates and photo references.

After CLIENT makes a choice, COMPANY will send a written PROPOSAL and CONTRACT to be reviewed and signed by CLIENT

At the moment of signing the CONTRACT, CLIENT must tender 50 (fifty)% of the full service price to the COMPANY.

The remaining payment must be tendered by CLIENT to the COMPANY at least 7 (seven) days prior to the scheduled event. After the remaining payment is tendered CLIENT will receive INSTRUCTIONS as to the final steps in coordination of the EVENT.

CLIENT will receive post production materials (photo and/or video footage) based on service terms and schedule outlined in the initial PROPOSAL.

GIFT DELIVERY TERMS AND PAYMENT SCHEDULE

When CLIENT engages in Company’s «WOW week», a 7-day gift delivery service, COMPANY will collect from CLIENT initial non-refundable deposit of $100 (one hundred), either in person or online, for the initial Gift Ideas List.

A unique QUESTIONNAIRE will be emailed to the CLIENT and may be submitted online, via phone call, Skype call or messengers to provide COMPANY with personalized feedback.

After the deposit is received, COMPANY will send a written PROPOSAL to CLIENT that includes unique and personalized gifts and gift ideas to be received by CLIENT or intended beneficiary. Detailed terms will be outlined in the CONTRACT between the company and CLIENT. After the contract is signed, the COMPANY will start its work as outlined in the CONTRACT.

SERVICES TERMS AND CONDITIONS

  1. CLIENT may not customize Company’s all inclusive PACKAGE to devalue its service price by deciding to remove certain services that are essential elements of the PACKAGE (ex. Save on Alcohol, Decor or Valet Parking)
  2. CLIENT understands, that by requesting the arranging of UNIQUE EVENT, COMPANY`S role will be that of advisor, event planner and coordinator. Client will make the actual selection of service providers and COMPANY will implement those selections.

3.CLIENT agrees to respond to any and all communications by COMPANY in a timely manner. Delays in communication can delay the event date.

4.CLIENT must notify COMPANY of any changes in a timely manner. COMPANY shall not be held liable for any changes made by The CLIENT or selected service providers.

5.CLIENT understands that planning of PACKAGE events is possible only prior the determined quantity of days due to the obtaining venue or/and city permits. COMPANY will do all the best to arrange event as fast as possible in case of small amount of time.

5.COMPANY is responsible for obtaining all permits for arranging PACKAGE events or permits for arranging UNIQUE EVENT. COMPANY doesn’t guarantee gaining of permit for requested date if it is not possible.

6.COMPANY reserves the right to cancel any scheduled EVENT or SERVICE due to IMPOSSIBILITY of obtaining such services due to the impact of weather, Acts of God, or nonperformance of vendors.

7.CLIENT understands that COMPANY will offer unique outdoor spots as part of its service package and the issue of unexpected weather change may arise at any time. CLIENT must be willing to reschedule EVENT or review possible Back-up plans in case of bad weather.

PAYMENTS, REFUND AND CANCELLATION POLICY

All deposits made to the COMPANY are not refundable.

CLIENT will be solely responsible for paying of all fees, sales tax, use tax, or other tax payable on production and delivery of all product(s) to CLIENT (other than sales tax arising from purchases of materials or supplies in connection with the production).

COMPANY will accept cash, PayPal, credit card (Visa, MasterCard, Discover, American Express) as payment. No checks of any kind will be accepted. All clients are required to have a credit card on file. Client’s credit card may be charged remotely provided a written authorization is on file with the COMPANY.

COMPANY shall be entitled to collect payment from CLIENT including company’s fees, costs and all vendor and supplier fees relating to any Services delivered or scheduled to be delivered to CLIENT.

If CLIENT wishes to cancel the EVENT for any reason, it shall immediately notify the Company in writing or directly by phone and upon cancellation shall be liable to pay 50% of the entire contract price including all costs and fees incurred or bound to be incurred by СOMPANY and all its agents, vendors and suppliers.

In case CLIENT or intended services beneficiary refuses to participate, or does not like the EVENT, no refunds of any kind will be provided.

RESHEDULING

In case of unexpected weather change (rain or wind) prior the EVENT, the COMPANY provides the following back-up plan as long as it is reasonably safe for all parties to conduct such EVENT :

  • Putting up a canopy at the outdoor location;
  • Change of location to the indoor location;
  • Change of venue;
  • Rescheduling to a different time and/or day.

If it is no possible and safe back-up plan for the same date and time, or CLIENT doesn’t like Back-up ideas , the EVENT can be reschedule for another day or time without additional fees. But No refund will be offered.

The COMPANY only provides ideas for Back-up plan but the CLIENT is responsible for all decisions made regarding the EVENT.

If CLIENT reschedules the EVENT due to weather conditions in the day of EVENT, additional fees for perishable goods must be paid in full within 24 (twenty four) hours after rescheduling.

PRIVACY POLICY

COMPANY respects the CLIENT`s privacy. COMPANY is committed to providing complete confidentiality to the CLIENT. COMPANY won`t sell or exchange CLIENT`s information. All information provided by the CLIENT, including, but not limited to, credit card information, email addresses, phone numbers, and addresses, personal information will be stored for the sole purpose of providing company`s SERVICES and billing the CLIENT for services rendered.
